About 16,000 people live in Spain and work in Gibraltar: 15,991 in September 2026, 11,252 of them Spanish, according to Gibraltar’s Statistics Office. Since 15 July 2026, when the UK-EU treaty on Gibraltar began to apply provisionally, the routine checks at the land border have gone. Schengen checks now happen at Gibraltar’s port and airport instead, and Gibraltar itself stays outside both Schengen and the EU. Frontier workers pay tax in Gibraltar on their pay through PAYE, and if they’re tax resident in Spain, Spain taxes them too, with credit for the Gibraltar tax.

What changed at the border

  • No physical barriers or routine checks on people crossing between Spain and Gibraltar: “All physical barriers related to the circulation of persons between the Union and Gibraltar shall be removed” (Article 28).
  • Checks at the port and airport instead: border crossing points at Gibraltar port and airport, with checks by Gibraltar’s authorities and then Spain’s (Article 29). The UK Government’s summary: all necessary immigration checks take place at the airport and, if needed, the port, “rather than at the land border”.
  • Gibraltar stays outside Schengen and the EU. Residents of Gibraltar are exempt from the EU’s Entry/Exit System (Article 42).

Rights at work

The treaty’s Part Four gives frontier workers (people working in Gibraltar who return to Spain at least once a week, and vice versa) the right to work in Gibraltar on the same rules as UK nationals there, and equal treatment on pay, dismissal and “social and tax advantages, except rights of access to housing”. They’re entitled to a document certifying their status, which can be digital (treaty text, CP 1645). Frontier workers should be registered with Gibraltar’s Department of Employment and Income Tax Office.

Tax: Gibraltar first, then Spain

  • Gibraltar taxes income earned in Gibraltar whatever your residence: “the system in Gibraltar enables tax to be charged on the basis of where the income is earned”. Your employer deducts it through PAYE (Income Tax Office FAQs).
  • Spain taxes its residents on their worldwide income. If you’re tax resident in Spain, you declare your Gibraltar salary there and deduct the lower of the tax paid in Gibraltar and the Spanish tax on that income (Ley 35/2006, art. 80).
  • Who is resident where is settled by the 2019 tax agreement between Spain and the UK on Gibraltar: among other tests, someone is resident in Spain if they spend more than 183 nights a year there, if their spouse or dependants live there, or if their only permanent home is there.
  • Spain took Gibraltar off its list of tax havens on 27 June 2026, saying Gibraltar now exchanges tax information effectively with Spain (Ministerio de Hacienda). Whether Spain’s exemption for work done abroad (up to €60,100) now applies to Gibraltar wasn’t confirmed by any official ruling we could find; ask a gestor or the Agencia Tributaria.

Gibraltar’s income tax rates and a worked example are on tax in Gibraltar.

Social insurance and healthcare

Frontier workers pay social insurance in Gibraltar, where they work: employees 10% of earnings, capped at £40.79 a week from July 2026. Under the treaty’s social security protocol they can get healthcare where they live (provided by the Spanish system on behalf of Gibraltar’s) and while in Gibraltar, where they work.

Limits

The treaty is applied provisionally and some details (status documents, the work-abroad exemption) are still settling. This is general information from official sources as of 28 October 2026, not tax or legal advice.

Questions

Is Gibraltar in the Schengen area?

No. Gibraltar stays outside both Schengen and the EU. But under the UK-EU treaty, applied provisionally since 15 July 2026, there are no routine checks at the land border with Spain; instead, people arriving at Gibraltar's port and airport are checked by Gibraltar and then by Spain, for Schengen.

Is the Gibraltar border open?

Yes. Since 15 July 2026, when the UK-EU treaty began to apply provisionally, the physical barriers and routine checks on people crossing between Spain and Gibraltar have been lifted. The treaty is not yet fully in force: the European Parliament's consent vote is expected around 14 December 2026.

Do frontier workers pay tax in Gibraltar or Spain?

Usually both, with credit. Gibraltar taxes pay earned in Gibraltar through PAYE, wherever you live. If you're tax resident in Spain, Spain taxes your worldwide income and gives you credit for the tax paid in Gibraltar, under the 2019 tax agreement between Spain and the UK and Spain's income tax law (Ley 35/2006, art. 80).

How many people cross from Spain to work in Gibraltar?

15,991 frontier workers lived in Spain and worked in Gibraltar in September 2026, of whom 11,252 were Spanish nationals, according to the Statistics Office. The UK Government puts it at about 15,000 people, over half of Gibraltar's workforce.

Where do frontier workers get healthcare?

Under the treaty's social security protocol, frontier workers pay social insurance in Gibraltar, where they work, and can get healthcare both in the country where they live and while in the place where they work.
